Article 1 – Definitions
In these general terms and conditions, the following terms have the following meanings:
Cooling-off period: the period during which the consumer may exercise the right of withdrawal.
Consumer: the natural person who is not acting in the exercise of a profession or business and who concludes a distance contract with the entrepreneur.
Day: calendar day.
Fixed-term transaction: a distance contract relating to a series of products and/or services whose delivery and/or purchase obligation extends over a certain period.
Durable data carrier: any means that allows the consumer or the business to store information addressed personally to them, in a way that enables future consultation and unchanged reproduction of the stored information.
Right of withdrawal: the consumer’s option to cancel the distance contract within the cooling-off period.
Entrepreneur: the natural or legal person offering products and/or services to consumers at a distance.
Distance contract: an agreement in which, up to the conclusion of the contract, only one or more means of distance communication are used within a system organized by the entrepreneur for the distance sale of products and/or services.
Means of distance communication: any method that can be used to conclude a contract without the consumer and the entrepreneur having to be in the same place at the same time.
General terms and conditions: these general terms and conditions of the entrepreneur.
Article 2 – Identity of the Business
Provided upon request by email.
Article 3 – Scope
These general terms and conditions apply to every offer made by the entrepreneur, every distance contract concluded, and every order placed between the entrepreneur and the consumer.
Before the distance contract is concluded, the consumer will receive the text of these general terms and conditions. If this is not possible, it will be stated—before the contract is concluded—that the conditions can be consulted at the entrepreneur’s premises and will be sent free of charge upon request.
If the distance contract is concluded electronically, the text of these conditions will be provided electronically before the contract is concluded, in such a way that the consumer can easily store it on a durable data carrier. If this is not possible, the location where the conditions can be consulted electronically will be indicated, and the conditions will be sent free of charge upon request.
If special product or service conditions apply in addition to these general terms, paragraphs 2 and 3 apply correspondingly, and in case of contradictory conditions, the consumer may rely on the provision most favorable to them.
If any provision in these terms is found to be invalid or void, the remainder of the agreement remains in force, and the invalid provision will be replaced by a new one reflecting the original intent as closely as possible.
Any situation not covered by these terms will be assessed “in the spirit” of these terms.
Any ambiguity regarding interpretation will also be interpreted “in the spirit” of these terms.
Article 4 – The Offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
The offer is subject to change. The entrepreneur may modify or adjust the offer.
The offer contains a complete and accurate description of the products and/or services offered, detailed enough for proper assessment by the consumer. If images are used, they represent the products and/or services truthfully. Obvious errors do not bind the entrepreneur.
All images, specifications, and information in the offer are indicative and cannot be grounds for compensation or contract termination.
Product images represent the products as accurately as possible, but color variations cannot be guaranteed.
Each offer includes clear information about:
-
the price, excluding import duties and sales tax (these are the customer’s responsibility; postal services apply the regulations for imports into the EU, meaning they collect VAT and clearance fees from the recipient)
-
any shipping fees
-
how the agreement is concluded
-
whether the right of withdrawal applies
-
payment, delivery, and execution
-
how long the offer is valid
-
communication costs if they differ from standard rates
-
whether the contract will be archived and how the consumer can access it
-
how the consumer can correct errors before finalising the order
-
available contract languages
-
applicable codes of conduct
-
the minimum contract duration for extended transactions
-
optional: available sizes, colors, material types
Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and meets the stated conditions.
If accepted electronically, the entrepreneur will immediately confirm receipt. Until confirmed, the consumer may cancel.
If concluded electronically, the entrepreneur will take technical and organizational measures to secure the data transfer and ensure a secure environment. If electronic payment is possible, appropriate security measures will be taken.
The entrepreneur may, within legal limits, check the consumer’s payment ability and other relevant factors. If there are valid reasons, the entrepreneur may refuse an order or impose special conditions.
The entrepreneur will provide the consumer with the following information in a durable form:
-
the business address for complaints
-
conditions for exercising the right of withdrawal or the statement that it does not apply
-
warranty and after-sales information
-
the information listed in Article 4(3) unless already provided
-
termination terms for contracts longer than one year or indefinite contracts
Every contract is subject to availability of products.
Article 6 – Right of Withdrawal
The consumer may cancel the purchase of products within 30 days without giving a reason.
During the cooling-off period, the consumer must handle the product carefully and only inspect it as needed to judge whether to keep it.
To exercise the right of withdrawal, the consumer must notify the entrepreneur within 30 days and return the product within 30 days afterward, with proof of shipment.
If the consumer does not notify or return within the required periods, the purchase becomes final.
Article 7 – Costs in Case of Withdrawal
Return shipping costs are paid by the consumer.
If the consumer has paid, the entrepreneur will refund within 30 days after receiving the return or proof of complete return.
Article 8 – Exclusion of the Right of Withdrawal
The entrepreneur may exclude the right of withdrawal for certain products and services if clearly stated before the contract is concluded.
Exclusion applies to products:
-
made to consumer specifications
-
clearly personalized
-
that cannot be returned due to their nature
-
that perish quickly
-
whose price depends on rapid financial market fluctuations
-
newspapers and magazines
-
audio/video recordings or software with a broken seal
-
hygiene items with a broken seal
Exclusion may also apply to services such as:
-
accommodation, transport, catering, leisure with fixed dates
-
services already started with consumer consent
-
betting and lotteries
Article 9 – Prices
Prices will not increase during the validity period except for VAT changes.
Variable prices tied to financial market fluctuations may occur and must be explained in the offer.
Price increases within three months are allowed only due to legal requirements.
After three months, increases are allowed only if the consumer may cancel the contract.
Due to VAT law, delivery occurs outside the EU; therefore, VAT and customs fees are collected from the recipient.
All prices are subject to printing and typing errors.
Article 10 – Execution and Warranty
The entrepreneur guarantees that the products or services comply with the contract, specifications, and reasonable durability expectations.
Defects must be reported within 30 days and returned in original packaging.
The warranty period corresponds to the manufacturer’s warranty.
The warranty is void if:
-
the consumer or third party repairs/changes the product
-
improper or negligent use occurs
-
damage results from government regulations
Article 11 – Delivery and Execution
Orders are processed carefully and delivered within 30 days unless otherwise agreed.
If a delay occurs, the consumer will be notified and may cancel the contract and receive a refund.
If delivery becomes impossible, a replacement item may be provided; the consumer retains the right of withdrawal.
Risk transfers to the consumer upon delivery.
Article 12 – Long-term Transactions: Duration, Termination, Renewal
The consumer may terminate a contract of indefinite duration with one month’s notice.
A fixed-term contract may be ended at the end of its term with one month's notice.
Silent renewal of fixed-term contracts is not allowed except under limited conditions for magazines.
Article 13 – Payment
Amounts must be paid within 7 working days unless otherwise agreed.
Errors in payment details must be reported immediately.
In case of non-payment, the entrepreneur may charge reasonable costs.
Article 14 – Complaints
Complaints must be submitted within 7 days of discovering defects.
Complaints will be answered within 30 days.
If unresolved, a dispute arises.
Article 15 – Disputes
Contracts under these terms are governed solely by Dutch law, even if the consumer lives abroad.
Article 16 – SMS Marketing
By agreeing to SMS marketing during checkout, you consent to receiving recurring SMS notifications (order updates, abandoned cart reminders), marketing messages, and transactional messages such as review requests.
To unsubscribe, reply STOP to any message.
Carrier fees may apply.
